• Client: Individuals or entities that access the client portal to review and purchase datasets collected from vendors.

• Services: All websites, platforms, tools, and functionalities provided by Paradigm Shift AI, including both the vendor portal and the client portal.

3. Account Registration and Responsibilities

• Account Creation: Vendors must create an account to access the data collection and recording platform. You agree to provide accurate, complete, and current information during registration and to update such information as necessary.

• User Obligations: Vendors are responsible for maintaining the confidentiality of their account credentials. You agree to notify us immediately of any unauthorized use or suspected breach of your account.

• Proper Use: You agree to use the Services only for lawful purposes and in accordance with these Terms. Any attempt to misuse the Services, interfere with their operation, or breach our security measures may result in suspension or termination of your account.

4. Data Collection and Submission

• Data Types: As a vendor, you will be required to provide screen recordings, mouse and keyboard inputs, and UI element detection data (which includes information about the applications you use). These files must be submitted as part of the tasks assigned by the Company.

• Accuracy and Integrity: You are expected to perform the tasks diligently and ensure that all data provided is accurate and complete. The Company reserves the right to review and verify the submitted data.

5. Third-Party Data Sharing and Business Model

• Data Sales: The data collected from vendors will be compiled into datasets and sold to clients. By submitting your data, you acknowledge and consent that your submissions may be aggregated, processed, and provided to third-party clients as part of our datasets.

• No Confidentiality Assurance: You agree that data submitted as part of the task may be shared with third parties, and the Company is not responsible for any direct or indirect use of the data beyond the scope of our services.

6. Intellectual Property

• Content Ownership: All content provided by the Company, including website content and software, is owned by Paradigm Shift AI or its licensors and is protected by applicable intellectual property laws.

• License to Use: Subject to your compliance with these Terms, the Company grants you a limited, non-exclusive, non-transferable license to access and use the Services for their intended purposes.

7. Disclaimers and Limitation of Liability

• “As Is” Basis: The Services are provided on an “as is” and “as available” basis without any warranties of any kind, whether express or implied.
